We collect personal data when you:

• Fill out our contact or quote forms
• Subscribe to our newsletter
• Write to us by email or WhatsApp, or call us

Data collected: name, company, email, phone, the content of your message and any files you attach. Providing this data is voluntary, but without it we cannot answer your request.

Technical data: when you send a form, we record the IP address, the browser, the device and the page from which it was sent, to protect our forms against abuse and to handle your request. When you visit the website, our host’s server records technical data (IP address, browser, pages visited, date and time) for security and operation. We count visits anonymously with Matomo, on the server that hosts our website and without cookies; with your consent, we also measure them with Google Analytics and Microsoft Clarity (see Section 6). If an AI assistant in your browser uses the tools our website provides for such assistants (WebMCP), we count this use without cookies and, if you then send us a request from a form the assistant filled in, we note this in your request (see Section 6).

Reviews: some of our pages show reviews published on Google, as their authors published them there, without their profile picture.

We use your data to answer your requests and prepare offers, to perform contracts and orders, to send you our newsletter if you have subscribed to it (you can unsubscribe at any time), to count visits anonymously, measure the use of our tools for AI assistants and improve the website, to protect the website, to comply with our legal obligations and to establish or defend legal claims. Where the EU GDPR applies, the legal bases are the performance of a contract or of pre-contractual steps, your consent, our legitimate interest in answering requests, knowing how the website is used, securing the website and defending legal claims, and our legal obligations.

Recipients: we never sell your data. We share it only as far as necessary, in particular: with service providers who process it on our behalf, such as our website host (TenWeb, Inc.) and our email delivery service; with suppliers, subcontractors and carriers involved in an order; with our advisers and, for unpaid invoices, debt collection agencies; and with authorities or courts where the law requires it or to protect our rights. If you write to us through WhatsApp, your message is processed by WhatsApp (Meta) under its own privacy policy. Some pages load content from third parties (YouTube, Cloudflare Turnstile and, only with your consent, Google Analytics and Microsoft Clarity), which then receive your IP address: see Section 6, Cookie Policy.

Transfers abroad: our service providers and the third parties named above (Google, Microsoft, Meta, Cloudflare) may process data outside Switzerland, in particular in the European Union or the United States. For a country without an adequate level of data protection, we rely on the safeguards provided for by law, such as standard contractual clauses, or on a legal exception, for example where the disclosure is necessary to perform a contract with you.

Security: we take appropriate technical and organisational measures to protect your data, such as encrypted connections (SSL/TLS) and access limited to the people who need it.

Our processing is subject to the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).

Under the FADP and, where applicable, the GDPR, you can:

• Find out which personal data we hold about you (right of access)
• Have inaccurate data corrected
• Have your data deleted, unless we are required or entitled to keep it
• Object to processing, or ask us to restrict it
• Receive your data in a common electronic format (data portability)
• Withdraw your consent at any time, without affecting processing already carried out

These rights apply within the conditions and limits set by law. To exercise them, write to info@hypervisual.ch; we may ask you to prove your identity. You can also contact the Federal Data Protection and Information Commissioner (FDPIC) or, if you live in the European Union, lodge a complaint with the data protection authority of your country.

Retention: we keep your data only as long as the purposes above require (including the defence of legal claims until they are time-barred) or as long as the law obliges us to (accounting records: 10 years under Swiss law).

Cookies: our website uses cookies that record your cookie choices and a few technical items in browser storage. Analytics cookies (Google Analytics, Microsoft Clarity) are set only if you accept them in the cookie banner; we use no advertising cookies. Our own visit statistics (Matomo) and our count of AI assistants using our tools work without cookies. Pages with an embedded YouTube video also let YouTube set its own cookies. Details in Section 6, Cookie Policy.

These Terms of Sale govern all commercial relationships between HYPERVISUAL Switzerland by HMF Corporation SA and its customers. They apply to sales and rentals of equipment, software licenses, and professional services.

Quotes: Valid for 15 days. Prices exclude VAT unless otherwise stated.

Confirmation: Signed quote + required deposit + complete technical specifications.

Modifications: May result in price and delivery adjustments. Cancellation of custom orders: fees up to 100%.

Pricing: Prices in CHF. VAT 8.1% added for Swiss deliveries.

Payment (quoted amount, excluding VAT):

• Under CHF 5’000: 100% on order, for purchase and rental
• CHF 5’000 to CHF 100’000: 60% on order, 40% on delivery
• Over CHF 100’000: 40% on order, 40% on delivery, 20% on acceptance (commissioning). Unless written reservations are made within 10 days of commissioning, the installation is deemed accepted.
• Due dates: the deposit is payable on order, and the order is launched only once it is received; subsequent invoices are payable at 30 days net.
• Rental: payment terms are set in the quote; equipment is delivered only once the payment set in the quote has been received.
• Public bodies and tenders: terms as set in the contract award.

Late payment: 5% annual interest. Collection costs charged to customer.

IMPORTANT: All delivery times communicated are provided for information purposes only and are NOT contractually binding.

Delivery times depend on factors beyond our control:

• Manufacturing times by suppliers/subcontractors
• Raw materials and components availability
• International shipping delays
• Customs clearance procedures
• Transportation and logistics constraints
• Custom order complexity

Supply chain dependency: HYPERVISUAL depends on international manufacturers and suppliers (particularly Asia). Third-party delays do not constitute breach of contract.

To the extent permitted by law, HYPERVISUAL shall not be liable for:

• Direct or indirect damages resulting from delays
• Loss of revenue, profits, or business opportunities
• Costs related to event cancellations/postponements
• Consequential or incidental damages
• Penalties imposed by third parties

The Customer waives any right to claim compensation, penalties, or contract termination based solely on delivery delays.

Customer obligation: Order with sufficient advance notice. Orders with insufficient lead time accepted at Customer’s own risk.

HYPERVISUAL is not responsible for delays or failures resulting from:

• Supplier/manufacturer delays
• International transportation disruptions
• Customs issues
• Natural disasters, epidemics, pandemics
• Labour disputes, strikes
• Technical failures
• Regulatory changes, import/export restrictions

Period: Defined in contract. Extension: request 48h before end.

Customer responsibility: Proper use, protection against damage/theft, return in good condition.

Damage/loss: Repair/replacement costs charged to Customer. Security deposits may apply.

Licenses: Non-transferable, limited to specified number of users.

Intellectual property: All software remains the property of HYPERVISUAL or its licensors. Custom developments are licensed for use (not owned).

Hardware: 24 months for manufacturing defects. Exclusions: misuse, normal wear, environmental factors, consumables.

Software: 12 months performance as documented.

Services: 90 days workmanship quality.

Claims: In writing with proof of purchase and detailed description.

Exclusions (to the extent permitted by Swiss law):

• Indirect, consequential, or incidental damages
• Loss of profits, business, or revenue
• Data loss or corruption
• Third-party claims

Cap: Total liability limited to amount paid for the specific product/service.

Reservation: The exclusions, limitations and waivers in these Terms of Sale apply only to the extent permitted by law; in particular, they do not apply to unlawful intent or gross negligence (Art. 100 CO), to liability under the Product Liability Act or to mandatory consumer rights.

Insurance: HMF Corporation SA is covered by a Professional Liability insurance policy underwritten by Generali Assurances Générales SA (Avenue Perdtemps 23, 1260 Nyon, Switzerland), policy no. 23-53-42-22.

Purpose: To mark the launch of its new website, HYPERVISUAL grants a launch discount. All of the conditions below must be met.

Discount: 10% off the price, excluding VAT, of the hardware shown in the quote, for both purchase and rental (LED, LCD and OLED screens, holograms, totems, kiosks, players and accessories).

Exclusions: the discount does not apply to:

• services: study, installation, assembly and dismantling, commissioning, training, maintenance, support, on-site technical staff;
• software licenses and subscriptions, including DATAVSN, content creation or adaptation, or custom development;
• transport, delivery, packaging, customs and insurance costs;
• security deposits.

Eligible quotes: only new quotes issued by HYPERVISUAL during the offer period qualify. The following are excluded:

• quotes issued before the start of the offer, even if still valid or under discussion;
• orders already confirmed or in progress;
• invoices already issued;
• ongoing rental contracts, their extensions and renewals.

Period: from 7 October 2026 to 15 November 2026 inclusive. The order must be confirmed within the meaning of Article 2 (signed quote and deposit received) no later than 15 November 2026. The 15-day validity of a quote does not extend the offer beyond that date.

How it applies: the discount is shown on the quote and on the invoice as a separate line; no code is needed. It cannot be applied retroactively or converted into a credit note or cash.

No combination: the offer cannot be combined with any other discount, promotion, special price, project price or negotiated terms.

Reservations: HYPERVISUAL may change or end the offer at any time, without affecting orders already confirmed. Any exception to these conditions, for example for a quote in progress, requires HYPERVISUAL’s written agreement.

The other articles of these terms apply unchanged. In the event of any conflict, this article prevails as regards the discount.

Deadline: Report within 30 days of delivery.

Eligibility: Unused items, original packaging, all accessories, proof of purchase.

Refund: 14 business days after receipt and inspection. Original payment method. Shipping costs non-refundable. 15% restocking fee may apply.

Return shipping: Customer’s responsibility. Insurance recommended >500 CHF.

These terms are governed by Swiss law, excluding conflict of law provisions and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

1. Negotiation: The parties agree to first attempt to resolve any dispute through good faith negotiation.

2. Mediation: If negotiation fails, submission to mediation under the Swiss Rules of Mediation.

3. Jurisdiction: Any unresolved dispute shall be submitted to the exclusive jurisdiction of the courts of Fribourg, Switzerland, subject to mandatory places of jurisdiction.

Severability: If any provision is found invalid, the others remain in effect.

Entirety: These terms, together with the quote or order confirmation, constitute the complete agreement and supersede all prior negotiations; in case of conflict, the quote or order confirmation prevails.

• Consent cookies (hypervisual.ch: cmplz_banner-status, cmplz_consented_services, cmplz_policy_id, cmplz_functional, cmplz_preferences, cmplz_statistics, cmplz_marketing): record your choices in the cookie banner. Functional cookies, kept for one year.
• Browser storage (hypervisual.ch): for the session only, odSubmitted and odStorageLockTime avoid sending the same page-layout measurement twice. This measurement (page address, window size, position of page elements) contains no personal data and only serves to display pages faster.
• YouTube cookies (youtube.com: YSC, VISITOR_INFO1_LIVE, VISITOR_PRIVACY_METADATA, __Secure-YNID, __Secure-ROLLOUT_TOKEN): set by YouTube only on pages with an embedded video, kept until the end of the session or up to six months. The videos use YouTube’s privacy-enhanced mode. YouTube uses these cookies to deliver the videos and for its own purposes, as described in Google’s privacy policy.
• Google Analytics (hypervisual.ch: _ga, _ga_JFG61FM83C): count visits and pages viewed and tell visitors apart, without revealing to us who they are. Set only after your consent, kept for up to two years. Without your consent, Google Analytics is not loaded.
• Microsoft Clarity (hypervisual.ch: _clck, _clsk; clarity.ms and bing.com: MUID, MR, SM, SRM_B, ANONCHK): show how the pages are used: clicks, scrolling, heat maps and session replays, with the content of form fields masked. Set only after your consent, kept from the end of the session up to one year. Without your consent, Clarity is not loaded.
• Matomo (hypervisual.ch, no cookie): our own visit statistics, for all visitors. Matomo counts the pages viewed, the site or search engine you came from, the approximate location (country, region, city), the type of device and browser, and the sending of our forms, without their content. It runs on the server that hosts our website and uses no cookies. Your IP address only serves to group the pages of a visit and to locate it, to the city at most; it is shortened (last two bytes removed) before being stored. Our reports show only totals, never a single visit or visitor. Nothing is shared with anyone, and the detailed data is deleted after 25 months at most. You can object below, under “Managing Your Preferences”; a cookie, mtm_consent_removed, then keeps your choice for 13 months.
• Tools for AI assistants (WebMCP) (hypervisual.ch, no cookie): our website offers tools to the AI assistants built into browsers, to read our pages and to fill in our forms, which you send yourself. When an assistant uses them, we count which tool is used and in which language, without cookies and without storing anything in your browser. To count each browser only once a day, an identifier is calculated from your IP address and your browser with a key that changes every day; the identifier and the key are deleted the next day, and the IP address is not kept. If you send us a request from a form the assistant filled in, we note in your request that it was prepared with an AI assistant. Nothing is shared with anyone.

Analytics cookies are set only with your consent. Our website sets no advertising cookies.

You can change or withdraw your consent at any time with the “Manage consent” button at the bottom of the screen. You can also delete or block cookies and browser storage at any time in your browser settings. Without them, the cookie banner simply asks for your choice again on each visit.

DATAVSN measures audiences without identifying anyone. The image is processed on the player; no face is recognised, and only aggregated statistics come out, such as the number of passers-by and the attention time.
